Gregg Latchams advises on pioneering fisheries programme

The Commercial, Technology & Data Protection team at Gregg Latchams has advised the Devon & Severn Inshore Fisheries and Conservation Authority (DSIFCA) on a pioneering programme to install inshore vessel monitoring systems (IVMS) on all towed gear fishing vessels of between 7-12m with a permit to fish within the district.

The pilot, which is funded by the European Maritime and Fisheries Fund, is the first of its kind in the UK and has the strong support of the Marine Maritime Organisation (MMO), other inshore authorities and local fishermen. IVMS technology provides near real-time reporting of the location of fishing vessels, to support the prosecution of illegal fishing activities and enable implementation of policies to support the sustainable use of the fishing district.

DSIFCA will purchase the IVMS devices from suppliers whose products have been approved by the MMO before they are installed on the fishing vessels and ownership of the devices transferred to the vessel owners. DSIFCA is then provided with access to data and support services by the suppliers.

Senior Associate Ed Boal advised DSIFCA on the contractual arrangements for the purchase of the IVMS devices, transfer of ownership to the vessel owners, support services agreements with suppliers and data protection matters.

Devon and Severn IFCA’s IVMS project relied upon successfully bringing many different partners and their expertise together. The project was supported by the provision of  excellent legal advice by Ed Boal regarding the drafting of the contractual agreements that needed to be put in place.
