Funding Family Legal Advice
In most family court proceedings there is a presumption that each party will be responsible for their own legal costs. However, in certain circumstances the court has the power to order one party to pay all or some of the other party’s costs.
If another person is ordered to pay your costs you will not necessarily recover from that person the full amount you have spent, and that person may also not be capable of meeting the order for payment. If an agreement cannot be reached about the amount of costs payable under a costs order this will be determined by the court. If the other party is in receipt of public funding (or legal aid) you are unlikely to recover your costs from them at all.
It is important to bear in mind that the court may order you to pay the costs of another party as well as your own.
